This End User License Agreement (“Agreement”) is between you (the restaurant or business using the OrderNow.al software, the “Customer”) and KAVIORA TECHNOLOGIES SHPK (NIPT M61628038K), Rruga Muhedin Llagani, Kompleksi Square 21, Shkallë 3, Ap. 11, Tiranë, Albania (“Kaviora”, “we”, “us”). By creating an account or using the software, you agree to this Agreement.
Subject to this Agreement and to your active subscription or trial, Kaviora grants you a limited, non-exclusive, non-transferable, revocable right to access and use the OrderNow.al software to manage your menus, orders, bookings, and related operations for your own restaurant business. This is a license to use the software as a service — not a sale, and no ownership of the software passes to you.
New customers receive a 15-day free trial. After the trial, continued use requires an active paid subscription at the plan rates then in effect. Fees are due as agreed at sign-up or invoicing. Access to certain features may be limited by your subscription tier. We may suspend or limit access if a subscription is unpaid or expired.
You are responsible for the accuracy of your menus, prices, allergen and ingredient information, and business and tax details; for honoring the orders and bookings you accept; and for keeping your account credentials secure. You are solely responsible for issuing legally compliant fiscalized invoices under Albanian law — the order summary produced by OrderNow.al is an operational document, not a fiscal receipt.
You may not use the software for any unlawful, infringing, fraudulent, or abusive purpose; resell or sublicense the software; or attempt to copy, modify, reverse-engineer, scrape, overload, or breach the software or its security. You may not use the software to send unlawful or unsolicited communications.
You retain ownership of your own business and menu content. You grant Kaviora the right to host, process, and display that content as needed to provide the service. Handling of personal data is described in our Privacy Policy. Where you collect diner personal data through the service, you are responsible for doing so lawfully.
The OrderNow.al platform, software, branding, and design are owned by Kaviora Technologies and protected by law. All rights not expressly granted to you are reserved by Kaviora.
The software is provided “as is” and “as available,” without warranties of any kind to the maximum extent permitted by Albanian law. We do not warrant that the service will be uninterrupted, error-free, or fit for any particular purpose.
To the maximum extent permitted by Albanian law, Kaviora is not liable for indirect, incidental, or consequential losses, lost profits, or lost data; for the acts of diners or third parties; for the quality or safety of food; or for your fiscalization or tax compliance. Nothing in this Agreement limits liability that cannot be limited by law.
This Agreement applies for as long as you use the software. You may stop using the service at any time. We may suspend or terminate access for breach of this Agreement or non-payment. On termination, your license ends; provisions that by their nature should survive (such as intellectual property, disclaimers, and liability) will survive.
We may update this Agreement from time to time. Material changes will be notified through the service, and continued use after an update constitutes acceptance of the updated Agreement.
This Agreement is governed by the laws of Albania, with disputes subject to the competent courts of Tiranë.
